Recently, there have been numerous complaints from companies about the EPA’s regulations on carbon dioxide emissions. Some companies are so frustrated that they are petitioning to have the Supreme Court hear their case. They are petitioning to have a case revisited from 2012.

The petitioners believe that the EPA should not regulate carbon emissions – for there is no common consensus or grounds to regulate it on. They cannot determine what is the proper amount of carbon emitted, or sometimes it is even difficult to know how much is actually being emitted.

Those petitioning found that the EPA did not properly use the PSD program in the Clean Air Act when creating regulations from power plants. This piece of evidence may be pivotal in their case. If the EPA is not properly using the program, they cannot uphold regulations.
